Just as a matter of interest, how do these organisations manage to obtain copyright on such a diversity of photos, especially school photos> know I wouldn't be happy if I came across an old school photograph with me on it for sale.

Just as a matter of interest, how do these organisations manage to obtain copyright on such a diversity of photos, especially school photos> know I wouldn't be happy if I came across an old school photograph with me on it for sale. The short answer is they don't have copyright in most cases. It's a well known and widespread con. Unless they can prove that theirs is the only copy of that photo in existence or that they are the owners of the original then they can't claim copyright. Where books are concerned an author can claim copyright for any text he attaches to a photo but again he can't claim copyright for the photo itself. The lesson there is, if you copy a photo from a book provide you're own text I have an option to place a copyright notice on this forum and all posts and photos herein which shows how silly the whole thing is. Copy away folks, it'll never get to court Jerry

....I wouldn't be happy if I came across an old school photograph with me on it for sale. Even if it was one you hadn't got? That wouldn't be very hard seeing as I haven't got any, but my point is I would want to know by what right they were selling them and how they obtained copyright that enabled them to sell it in the first place. I believe that the original photographer has a right to expect some compensation for his time, effort and outlay. Though I don't believe he has a right to sell that expectation on in perpetuity and that other people have a right to claim copyright.
